That is my thought. The first one is purely accidental, second I think is avoidable, but not sure if deliberate act. His leg is splayed and is landing on the right side of the player. He then moves this into a position that connects with the players back.

If you're convicting someone of a crime (SFP/VC/Spitting etc...) you need a degree of certainty (a high bar), otherwise (just as in Criminal Law within reason) you risk 'wrongly convicted', which is the worst outcome of all
