The "emotionally drained" line came from his lawyer, not the magistrates.

He was found guilty, fined £120.00 with £135.00 costs but avoided a banning order which would have banned him from all football because he had no previous convictions for football-related offences. He can still be banned by Villa.

The lighter didn't hit the assistant, didn't even get close to him by all accounts and the defendant claims it wasn't aimed at the assistant. So whilst it is disappointing that he was not given a football ban this is hardly "carte blanche" to throw things on to football pitches.
