defenders in the area at penalties - new laws

What if the encroaching defender is a former team-mate of the kicker and points to tell the GK which way to dive, and the GK saves it? Without encroachment there's not much to be done about that. But if encroaching, could it count as clearly impacting on the kicker?
No. That’s just the defender having an awareness of the game. It’s no different to seeing GK’s with charts printed onto their water bottle with where they should dive for each player’s penalty.

Don't follow. Are you mixing things up here?
There is no such thing as "former team-mate of the kicker" in the laws. It's either those on the team sheet such as players, subs etc, or an outside agent. Encroachment only applies to players. Anyone else can either interfere or not interfere. Either case is clear in law how to deal with.
"Former team-mate" only to indicate that the encroaching player might have a better idea than most which way the ball was going and thus which way the GK should dive, especially after seeing the kicker's run up. Defender encroaches and is gesticualting to the GK who goes the right way and saves. If the defender shouted "go right" and the GK dived that way and saved it, what would you do? A shout could clearly impact on the kicker, but mere gesticulation that the kicker isn't aware of?

(I'll submit it to "You are the Referee....")

That's just research (or spying). No encroachment - which is an offence, even if not penalised if it doesn't affect the outcome of the PK.

But in this scenario the encroachment is totally irrelevant. The player could do the same thing without encroachment, therefore his encroachment isn't impactful. If the shout impacted the kicker then that would be a totally different issue, and would be no different to how you would deal with a non encroaching player shouting something that impacted the kicker.

This. The shouting is either a verbal offence or is not. The fact that he tell the keeper and the keeper saves it has not say in deciding if it's an offence. Only consideration is if it distracts an opponent, likely kicker. This is entirely a subjective decision and up to the referee. If a goal was scored, it is unlikely I would say it distracted an opponent. If a goal is not scored, and the referee decides it was verbal distraction then pen is retaken. In either case if the referee decides it was verbal distraction then the offender is cautioned.
