Perhaps because the very first line of Law 11 says, "It is not an offence to be in an offside position."If it's an offside position not sure how it can be argued it's anything other than an offside offence... If that makes sense.
But if you mean that it has to be an offside offence because the player in an offside position has clearly challenged an opponent for the ball (thereby committing an offside offence) before the potential foul occurred, then I'm with you.
