Did the three man, former elite referees panel appointed by the f.a. get it right?

Looks like Toure momentarily lost his senses, immediately realised what he'd done, and felt kind of bad for it and ashamed. Maybe the panel have started taking facial expressions of remorse into account? ;-)

I understand that only one of the three has to deem it not to be violent conduct for a player to escape punishment

I would say definitely VC, he has kicked out at an opponent in frustration and anger just like most VC's. I see what you mean about the remorse but just because he might feel/look sorry he has still kicked an opponent. Definite 3 match ban for me.
